The crack on the seat tube literally goes all the way around and is just underneath the clamp. Haven't had a chance to see how bad it is. I am watching a replacement aero seat post on eBay which is. Carbon frame seat tube crack filler. There is a crack in the center of the carbon, about 2cm long where the seat tube made the layup in the back bow out. Additionally, there's a crack on the right side (closest to the camera) about 4cm where the paint and the outermost layer of carbon lifted up. If the cracks are just in the top of the seat tube and have not grown I would ride. I doubt you are going to have the bike shatter under you. If any crack has moved into the top tube or seat stay then you have a problem. If the shop refused to work on the bike that is a pretty strong statement.
